A CUDDINGTON woman who falsely accused a man of rape was remanded in custody due to the ‘serious risk’ she presents to the public.
Miya Brocklehurst, of Warrington Road, admitted perverting the court of justice with her bogus claim at a pre-trial preparation hearing at Chester Crown Court on Friday, May 22.
However, when she returned for sentencing on Wednesday, October 21, His Honour Judge Steven Everett said the contents of her pre-sentence report ‘raised really serious concerns’.
Judge Everett acknowledged the 19-year-old is currently undergoing psychiatric treatment in the community.
However, he said in his view, Brocklehurst ‘presents a very high risk of re-offending’, and such offending ‘carried a very high risk of causing serious harm’.
Addressing the defendant directly, he said: “I have taken your mental health concerns into account, but it is my job to balance your needs with those of the community.
“In my view, you present a very high risk.
“Be in no doubt, when you are sentenced, custody will be at the very top of the menu, whether this be prison, or some kind of hospital order.
“Time served on remand will be deducted from any sentence you receive.”
Judge Everett adjourned the hearing to allow time for Brocklehurst to undergo a full psychiatric evaluation.
She will return to court on Thursday, December 10.
